Rep. LaMonica McIver Is Pregnant and Facing 17 Years on Federal Fighting Federal Charges
Rep. LaMonica McIver, a Democrat representing New Jersey’s 10th District, is eight months pregnant and facing up to 17 years in federal prison over charges stemming from a confrontation with ICE officers at Newark’s Delaney Hall detention facility in May 2025. McIver had joined several New Jersey lawmakers for an authorized congressional oversight visit after reports of poor conditions inside the facility. During a chaotic clash outside the secured area — involving ICE agents, demonstrators, congressional staff, and Newark Mayor Ras Baraka — prosecutors allege McIver forcibly impeded federal officers, including striking two agents with her forearms. McIver insists she was performing her constitutional duty and has pleaded not guilty.
McIver says the prosecution is politically motivated, arguing she is being selectively targeted by the Trump administration for standing up to aggressive immigration enforcement. She is the only member of Congress indicted by Trump’s DOJ. A federal appeals court recently declined to dismiss the charges, ruling that her actions were “non‑legislative” and not protected by the Constitution’s Speech or Debate Clause — a decision McIver says “emboldens” the administration to retaliate against elected officials who conduct oversight.
Her case has drawn national attention because she filled the seat of the late Rep. Donald Payne Sr., has barely served a full term, and is now running for re‑election while fighting felony charges that have already cost her more than $1 million in legal fees. McIver says her priority is ensuring she can “give birth healthy,” but she refuses to step down, telling supporters she “will not fold” under pressure.
